1. States Direct Insurers to Waive Cost-Sharing for COVID-19 Please click HERE for a Compliance Alert, which includes details on the States directing Insurers to waive cost-sharing for COVID-19. 2. IRS Notice 2020-15: High-Deductible Health Plans Can Cover Coronavirus Costs Additionally, please click HERE for details on IRS Notice 2020-15 advising that high-deductible health plans (HDHPs) can pay for 2019 Novel Coronavirus (COVID-19) related testing and treatment, without jeopardizing their status. 3. DOL: Can an Employee Stay Home Under FMLA Leave to Avoid Getting Pandemic Influenza? The FMLA protects eligible employees who are incapacitated by a serious health condition, as may be the case with the flu where complications arise, or who are needed to care for covered family members who are incapacitated by a serious health condition. Leave taken by an employee for the purpose of avoiding exposure to the flu would not be protected under FMLA. Employers should encourage employees who are ill with pandemic influenza or are exposed to ill family members to stay home and should consider flexible leave policies for their employees in these circumstances.
